Abstract

Forced marriage is one of the polemics that occur in Indonesia. Forced marriage is seen as undermining the concept of equality and is considered to be included in the category of discrimination because it is considered not to defend the interests of the role of women. Forced marriage against women is an act of violence against women that can cause misery. This makes a religious attitude in the results of the religious deliberations of the Indonesian Women’s Ulama Congress or commonly known as KUPI. KUPI in this case responds with a statement of attitude regarding protection for women from the dangers of forced marriage. This research uses a descriptive qualitative approach with library research. This descriptive qualitative approach is used as a basis to be able to reduce and analyze the phenomena that occur while still based on literature related to coercion in marriage from a gender perspective. To examine the results in depth about the analysis of the Indonesian Women’s Ulama fatwa on forced marriage based on a gender perspective. It can be concluded that the danger of forced marriage has many adverse effects. Forced marriage can threaten the safety of women, such as psychological trauma, depression, negative stigma, family conflict, infidelity, social ostracism, divorce and the most feared unwanted actions such as suicide due to despair. KUPI does not approve of forced marriage because it minimizes the adverse effects on women as victims of forced marriage, this makes legislation that is able to provide guarantees or criminal sanctions for perpetrators of forced marriage mandatory.
