GENDER DIALCTICS IN AUTHORITARIAN AND AUTHORITATIVE JURISPRUDENCE IN POST TRUTH ERA

Abstract

The  gender justice fighters and several of activism were reviewing intensively. They are patiently accompanying the victims of trafiking, violence, rape, etc. However, there are many gender justice locomotion stumbling by religious problems. Mysoginistyc and discriminatory religious interpretation (tafsir) against women are one of the problems that they face, this would result to an au/thoritarian legal product /jurisprudence (fiqh) and away from authoritative jurisprudence, for example, the clerical fatwa about the prohibition for women from working outside their house without being accompanied by a mahram, then the activists often can not argue. When religious leaders preach about a husband's beating of wives, many activists do not have a lot of religious arguments to spare. Al-Qur'an and Al-Hadith became easily to be ploughed and manipulated a few people to justify the self interest, therefore,  law away from the  maslahah and close to the Madharat.
