Pemenuhan Hak Politik Penyandang Disabilitas dalam Penyelenggaraan Pemilu Tahun 2019 di Kabupaten Cirebon Perspektif Fiqih Siyasah

Abstract

Article 28D paragraph 3 of the 1945 Constitution states that every citizen has the right to obtain equal opportunities in government. Based on these provisions, every citizen has the same political rights, including Persons with Disabilities. Islam also views humans as having the same rights. So the state is obliged to respect, protect and fulfill the rights of Persons with Disabilities. Elections are a political agenda that the state can use to fulfill the political rights of Persons with Disabilities. Cirebon Regency in 2023 and 2024 is scheduled to hold Pilkada and General Elections. However, if you look at the 2019 Election in Cirebon Regency, the participation of Persons with Disabilities is still minimal. This can be seen by the absence of Election contestants who come from Persons with Disabilities. Fulfillment of the political rights of Persons with Disabilities in Elections in Cirebon Regency did not work as stipulated in the Legislation. This study aims to determine the importance of fulfilling the political rights of Persons with Disabilities in elections. This study used qualitative methods, with data collection techniques from literature studies, interviews and documentation. With this research, it is hoped that the fulfillment of the rights of Persons with Disabilities in Cirebon Regency can be implemented properly.
